The Delhi High Court on Tuesday asked the Centre and Delhi Police to respond to a plea by Delhi Minister Manjinder Singh Sirsa seeking production of a police officer’s report allegedly mentioning the presence of Congress leader Kamal Nath at Gurudwara Rakab Ganj Sahib near Parliament House, during the 1984 anti-Sikh riots.
Mr. Sirsa sought a direction to the authorities to place on record the report submitted by Gautam Kaul, the then Additional Commissioner of Police, “categorically showing the presence of Mr. Nath at the scene of crime, that is, Gurudwara Rakab Ganj Sahib”.
Senior advocate H. S. Phoolka, representing the petitioner, submitted that Mr. Nath’s presence at the crime scene was “well documented in police records”, besides multiple newspapers had “mentioned his presence” at the place and time of the incident, but those aspects were “not considered” by the government in its status report.
The plea sought a direction to take action against Mr. Nath in the FIR lodged in 1984 at Parliament Street police station, in which five persons were named as accused and allegedly accommodated at the Congress leader’s house. The accused were discharged due to insufficient evidence. However, Mr. Nath was never named in the FIR.
The case concerns a mob storming Gurdwara Rakab Ganj Sahib. The petition says two Sikhs, Inderjeet Singh and Manmohan Singh, were burned alive in the compound by a mob allegedly led by Mr. Nath.
