New Delhi

A Delhi court on Friday refused to order the police to disclose the content of the CCTV footage collected from the accident site where a BMW car had killed senior Finance Ministry official Navjot Singh and injured his wife. The couple were travelling on a motorbike and the BMW car had crashed into it.

The counsel for the accused, the driver of the car Gaganpreet Makkad, had filed an application in court seeking orders for the prosecution to file a reply whether the footage as preserved contains the entire incident as it happened and whether the same has been analysed. The accused’s counsel submitted that he only wants the statement from the prosecuting agency that the crime is covered in the seized footage.

Judicial Magistrate First Class (JMFC) Ankit Garg of Patiala House Courts noted that the investigation in the matter is pending and the accused cannot ask the prosecuting agency to make a statement as to what evidence has been collected by them till date. “Here, the accused is asking for a specific statement from the prosecuting agency that they have collected evidence which contains the incident of the crime from specific cameras. Orders for preservation of CCTV footage have already been given and clarification has also been sought from SHO to see whether the seized footage contains footage from cameras at pillar no. 65 and 67,” the court said.

It added that the prosecuting agency, at the behest of accused, cannot be forced to tell the veracity and contents of the evidence, as collected by them.

The court posted the next hearing on Saturday.
