Karnataka HC quashes criminal cases in Bengaluru road-rage case as IAF officer and call centre employee withdraw allegations against each other


The Karnataka High Court has quashed two criminal cases registered in connection with a road-rage incident in Bengaluru reported in April this year involving a wing commander of the Indian Air Force (IAF) and an employee of a call centre, after both chose to give quietus to the issue by withdrawing the complaints lodged against each other.

Justice Sachin Shankar Magadum passed the order while allowing the separate petitions filed by Wg. Com. Shiladitya Bose and Vikas Kumar S.J., an employee of a call centre, for quashing the FIRs registered against them.

During the pendency of their petitions, both of them chose to compromise the issue while terming it a trivial incident of road rage, resulting only in verbal exchanges between the parties.

Both Mr. Bose and Mr. Kumar personally appeared before the court and said that they did not sustain any injuries during the incident.

“Continuation of proceedings in such circumstances would serve no fruitful purpose and would amount to an abuse of the process of law. This court has also kept in mind the fact that one of the accused is a serving Air Force Officer, who would otherwise be compelled to face criminal proceedings despite the matter being trivial and settled. Having regard to the statements of the complainants, the voluntary withdrawal of allegations, and the absence of any injury, this court is satisfied that both petitions deserve to be allowed,” the court said in its order.

The incident had come to light after CCTV footage of the fight between the duo had gone viral on social media. Mr. Bose initially lodged a complaint against Mr. Kumar, who subsequently lodged a counter complaint against the former alleging attempt to murder.
